the question is when. when that happens, what -- how do these protestors react? i think it's safe to assume, dana, that they will only accelerate in other parts of the country. >> dana: possibly. with graduation and people going home for the summer, you might get a little bit of a lessening of it. they aren't talking about palestine so much anymore. the university of chicago they're asking for the green new deal and for admissions to be cut by 50% by 2030. >> one sign side blank your borders. >> dana: they want to end campus police at the university of utah. a lot of this has morphed and become left wing progressive nonsense. the president of the united states we'll wait to see what he has to say. so far he hasn't said much at all except on paper. a quick couple of hours. harris faulkner will take you through the next hour. here she is. >> harris: let's begin with the breaking news as we monitor
8:01 am
former president trump's new york criminal trial. moment by moment updates. journalists and producers are in the courtroom and we'll stay on the right side of your screen right now. and at any moment president biden is expected to speak on the anti-israel protesting that is rocking college campuses across america. and that would be the first time in about nine days that he said anything on the explosion of anti-semitism we have been watching. he has been talking through the white house press secretary and his other representatives and spokes people but to hear from the commander-in-chief when the nation is covered in protests among young people in particular. and that is a segment of the voting base for the democratic party that he will desperately need to win re-election in november. not to have heard from him on that, not to have heard from him definitively on the anti-israel and anti-jewish hate that is
8:02 am
just all over these campuses right now has been odd not to see. so we look forward to that. we can't promise he will talk about that but there will be journalists there and you can bet he will be asked about it. i'm harris faulkner and you are in "the faulkner focus." another day of violence at a different major american university. [flash bangs] >> harris: we're going to take you to the left coast of america, police descending on the university of california in los angeles. the crackdown on that campus, on ucla's anti-israel encampment is happening days after anarchy, we're already seeing it happen at columbia university. schools are finally calling in
8:03 am
law enforcement and clearing out those dangerous manifestations of hate against jews. officers in riot gear tore down plywood and removed pallets and metal barriers. we see some of that on the video. they used smoke flares and flash bangs that you could hear. they were trying to control the crowd. look at the guy, he is not just wearing a mask, he had on goggles, too, did you see that? they don't want you to know who they are. we know they hate. then they started making arrests and the show of force after only scenes like this earlier this week. watch. pro-israel counter protestors took on their rivals. the outcome chaos and violence before police arrived in riot gear, william la jeunesse was standing by at ucla. and will bring us up to date. first i want to go to peter doocy at the white house. we're waiting on the president
8:04 am
to speak. peter. >> you mentioned it has been a couple of days. april 22nd was the last time president biden talked about this and wasn't prepared remarks, just a stray question that a pool producer managed to get to him while he was exiting an earth day event. this is what he said then. >> president biden: i condemn the anti-semitic protests. why i've started a program to deal with that. i also condemn those who don't understand what's going on with the palestinians. >> a lot of folks, critics of president biden, said it was similar to president trump's remarks after charlottesville where he said there are very fine people on both sides. yesterday karine jean-pierre said fundamentally they are are not the same. bad faith to say that. that's really all that we've been getting. they have not told us which university presidents the president has talked to or how much of this he has been consuming on tv like the rest of us. instead, they have just been telling us and assuring us he is
8:05 am
being briefed in realtime. >> the president has not been silent on this issue when it comes to hate speech, anti-semitism. he launched the first-ever anti-semitism strategy to counter anti-semitism. something no other president did. we are going to continue to do the work. as the president is being kept regularly updated on what is happening, he is monitoring the situation closely. >> and that's critical. they are looking at this as something that president biden doesn't need to talk about every day. something crazy happens overnight on a college campus. they think he has such a strong record speaking out against anti-semitism. when you look at it. he does have a strong record, just not this week. he put out an anti-semitism plan for college campuses but since that plan went out, there has been vile anti-semitic rhetoric. buildings have been occupied, lawns have been posting these huge encampments.
8:06 am
so there are huge problems that he has not responded to. it represents a big difference between his comments in 2017 after charlottesville and anything that he has done or said in 2024. so as we look at what he is going to say any minute in the roosevelt room, where they have a small group of press that has been assigned just to travel with him today, standing by, it will likely be updated to be less of the kind of yes, it's wrong what is happening anti-semiticly but also wrong what is happening people that don't understand the palestinians. it is probably going to be different than that. >> harris: anti-semitism, jewish hate. all of it we should have heard from him even if he is repeating himself if that's what he says he would do. just keep doing it. tell the people that they are wrong for carrying out threats against jewish students, so on and so forth. places like brown university are negotiating with the agitators,
8:07 am
protestors, some students and people who come onto campus to join the fray. one of the things they say that they want is for these universities to divest any monies from israel. this goes beyond feeding palestinians in case anyone was wondering. the president has a lot to talk about if he chooses to go there. peter doocy, thank you very much. let's go back to the university of california in los angeles where police are clearing that encampment there. they began at 3:00 a.m. students and professors are sharing how it has been to live and to exist on campus lately. >> jews were not allowed to go into the campus. jews were not allowed to go into the library or allowed to go to classes. it was never peaceful. >> this looks like a war zone. it demonstrates to me that this school is run by a bunch of cowards. >> ucla needs to step up and keep their jewish students safe. it was a total disaster.
8:08 am
>> harris: william la jeunesse is at ucla and at the center of it all pre-dawn this morning. quite a day already, william. >> yeah, it sure has. the campus is closed now. the university wants students to avoid this quad area. maybe you can see why. police are now moving in again. but i want to show you one important area, right? a lot of people wonder how did this encampment continue to resupply itself? it was right through here, the back door area they have continued to bring in supplies, plywood, power tools, you name it. came through here and had to have a password or i.d. this is basically royce hall. i will take you down here. you can see security is just begin to arrive. they haven't been here all morning since police left. here you can take a look at some of the graffiti on the walls along here. spray painted.
8:09 am
>> harris: p president of the united states is speaking. >> president biden: the right to free speech and for people to peacefully assembly and make their voices heard. the second is the rule of law. both must be upheld. we are not an authoritarian nation where we silence people or squash dissent. the american people are heard. in fact, peaceful protests is in the best tradition how americans respond to issues. but -- but neither are we a lawless country. we are a civil society. order must prevail. throughout history we've faced moments like this because we are a big, diverse, free thinking and freedom loving nation. moments like this are always those who rush into score political points. but this isn't a moment for politics. it's a moment for clarity. so let me be clear, peaceful protests in america, violent protest is not protected.
8:10 am
peaceful protest is. it's against the law when violence occurs. destroying property is not a peaceful protest. it's against the law. vandalism, trespassing, breaking windows, shutting down campuses, forcing the cancellation of classes and graduations, none of this is a peaceful protest. threatening people, intimidating people, instilling fear in people is not peaceful protest. it's against the law. dissent is essential but it must never lead to disorder or denying the rights of others so students can end the semester and finish their education. it is matter of fairness and what's right. the right to protest but not the right to cause chaos. people have the right to get an education, the right to get a degree, the right to walk across a campus safely without fear of being attacked. let's be clear about this as well, there should be no place
8:11 am
in any campus, no place in america, for anti-semitism or threats of violence against jewish students. there is no place for hate speech or violence of any kind whether it's anti-semitism, islamaphobia or discrimination against arab americans or palestinian americans. it is simply wrong. there is no place for racism in america. it's all wrong. it's unamerican. i understand people have strong feelings and deep convictions. and in america we respect the right and protect the right for them to express that. but it doesn't mean anything goes. it needs to be done without violence, without destruction, without hate, and within the law. make no mistake, as president i will always defend free speech and i will always be just as strong standing up for the rule of law. that's my responsibility to you, the american people. my obligation to the
8:12 am
constitution. thank you very much. >> mr. president, have the press forced you to reconsider our policies? >> no, thank you. >> do you think the national guard should intervene? >> president biden: no. >> mr. president, the former president said -- >> dana: wow, okay. so those as we heard from peter doocy it's a small group of media who are tasked with -- that's the travel group today. he is going to see them again. this is the first time in nine days that we've heard from the president on this. let's go deeper. ben domenech, editor at large for the spectator, leo terrell civil rights attorney from the ucla school of law. interesting to hear from him on a sun dry of things. phil holloway, former district attorney and legal advisor to the georgia sheriff's department. we just saw the president walk away.
8:13 am
ben, i will start with you. >> look, i think this is the most forceful thing he has said to this point. obviously it is a carefully crafted statement. one that i think acknowledges the fact that he has frankly been ignoring this issue for too long and this white house, i think, acknowledges now this is a problem for them. it's a political problem for them. he can talk about people rushing in to score points. i don't think that's actually what was going on here. i think the american people were sitting back and looking at what was playing out on these campuses waiting for the president to show some leadership, to stand up for the jewish communities in these areas and to frankly speak to a lot of people who are part of his democratic coalition who are engaged in this type of chaotic behavior. they've been waiting. he has finally done it. we'll see if there is any actual impact from this in terms of a response from campuses or from add min is -- administrators.
8:14 am
we'll see where it goes from here. >> harris: phil holloway, address the substance of the president's comments and any of it, as ben is talking about, that you think legally might compel some of these universities to step up. >> harris, i think technically he said the right words. legally is on point. the first amendment protections end when things get violent. first amendment protections end when they bar jewish students from going into buildings where they are entitled to go. the first amendment protections end when they put up encampments on property they do not own. however, he came too late. where was he a week and a half or so ago before things got out of hand? that's when the president needed to show some leadership. he didn't do it. just like we saw no leadership from the president of columbia university or even ucla. they allowed these individuals to get a foothold.
8:15 am
allowed them to bring cardboard and other things in there and to build these encampments. they let these people own that property with the tools they needed to create this chaos. this should have been addressed and nipped in the bud a week or week and a half ago. that being said, the president's words were on point. he said what the first amendment means and it does not allow for unpeaceful, violent protests, things that violate the rights of third parties. >> harris: leo, your alma mater is the university of california at los angeles. ucla. and i want to get first your take on what you've seen unfold and continue to since 3:00 a.m. >> harris, i went to law school there. that is not the school i went to. i went to ucla law school. that was a national embarrassment. i respect my colleagues but the president gave a generic speech on what the first amendment is. i get it.
8:16 am
what you are watching and what the fox viewers are watching at ucla last night is not free speech. that's everything that is -- represents criminal conduct. i don't see free speech at ucla right now. that's criminal conduct. what is missing from the speech is what are you going to do to protect jewish american citizens? where is it? i heard nothing. i heard crickets. i want to give everybody a news flash. all those individuals that were arrested, we're in los angeles, they'll be released. we are in george gascon territory. he won't prosecute anyone. where is mayor bass and governor newsom? i didn't hear anything. one final point, harris, president trump and the federal government can stop everything that's going on. it is called title vi. it is called the f.b.i. it is called the department of justice. no federal prosecution whatsoever. what i'm seeing here as a law student and ucla law student and
8:17 am
civil rights attorney? i see the jewish american students being victimized just like black students were in the 50s and 60s. they were protected by the federal government. they had federal marshals. they had protection. jewish american citizens are not being protected by president joe biden and the democrats. >> harris: you bring up an interesting point. i want to further the leo is saying. the f.b.i. director said their number one focus has been hate crimes. and how they are exploding across the united states. that was previous to october 7th. the border then became also, you know, right alongside that issue. as leo is pointing out, the hate speech, the threats to kill, just alone the physical that we've seen when we talk with
8:18 am
students who say they are physically held back by students who say they are pro-palestinian, anti-israel, what do you make of the f.b.i. not getting involved at this point? >> harris, actions speak louder than words. if the f.b.i. wants to start prosecuting these people that are barring jewish people from attending class, if the federal authorities want to start prosecuting people for false imprisonment and other federal violations, then we'll have something. but until the f.b.i. and the department of justice actually do something, these are just hollow words. instead we will be left with the local prosecutors who we already see in many places do nothing. they could learn a lot from the governors of texas and georgia and florida and elsewhere where these governors showed leadership and said it won't be tolerated. if you violate the law you will be prosecuted to the fullest extent of the law and you don't see those things happening in those states.
8:19 am
it takes leadership. something that we have not unfortunately seen from this administration. >> harris: gentlemen, will you be with me for this hour. police are patrolling the campus of portland state university as anti-israel protests are raging on yet another campus, as they are across the country. plus another gag order hearing in the historic new york versus trump trial. why his defense team says it is so unfair that the former president cannot talk but others in the case can do all sorts of things in his name. they can defame him, they can lie, or speaking of lying, the professional and convicted liar michael cohen is putting out posts. he can do that. it is part of the proof to defend the former president against the gag order. stay close.

>> harris: all right. just a quick wrap-up now with leo terrell, ben domenech and phil holloway. the trial is on a break now. the defense is set to cross-examine the former attorney to stormy daniels and karen mcdougal. leo, i come to you first for your quick last thoughts. >> harris, this is a waste of time in the legal system. it is not a case of a criminal case. it is a political case designed to hurt trump and it is going to fail. >> harris: phil. >> we've heard little to nothing about any crimes committed by donald trump. we have learned a lot about how campaigns don't want negative information to get out. we have learned a lot about catch and kill. we have not seen any criminal

conduct. what we have seen is a biased judge who is itching to put donald trump in jail so regardless of how shoddy the prosecutor's case is we have to worry that the result will be something that is unfair. >> harris: this is live right now. the former president of the united states, donald trump, and his defense team have just walked back into court. so they are getting ready to resume. their breaks have been short today. they started off with a gag order hearing to see whether or not this judge would go after him again and fine him $1 thousand for four additional gag order violations that the prosecution is alleging. we didn't see the threat to throw him in jail, though, by the prosecution. we haven't heard it again by the judge. he had said that earlier. ben, your thoughts. >> the american people care a lot more about the violence they see occurring on campuses and the violence they see on the american border and about chaos around the world than anything

that's going on in that courtroom. that's not going to change. it is a real problem for democrats who had pinned their hopes to this to bring down the former president. >> harris: what does it mean for trump, just the last one with you, ben? >> i think that this for trump to navigate this situation, he will continue to run up against these gag orders but i don't think it hurts him at all to engage in this. you are talking about $1 thousand here and there for him spouting off on something where most people agree with him. >> harris: he is allowed to say with the man who has a doll of him in an orange jumpily jump sight and not allowed to comment on that. >> who is the con here? >> harris: andy mccarthy said trump should hand the judge a $10,000 check for covering what i will say this week. "outnumbered" after the break.
