police tape strung across train tracks and a pink cell phone where a teenager was killed. tonight, witnesses tell us she was distracted. good evening, i'm frank somerville. >> and i'm julie haener. police are still on the scene of that collision involving an amtrak train and a terning. ktvu's ken pritchett joins us from the scene of that collision at hesperia boulevard and spring lake drive.

>> reporter: this 18-year-old victim was walking southbound here along hesperia boulevard. she lives next to these tracks in that apartment complex. it was a horrific scene here, because of a young person who died along these tracks, but also because there were friends and families here, and we witnessed them put this story together and realize it was their loved one who died. this is 18-year-old britany silva. she was college bound, says her father, until this evening, when she was killed by a southbound amtrak train. this man was walking close to her as she began to cross the tracks. >> i saw her. go now, go now, go now, now. >> reporter: he says silva was on a phone. the phone you see here in the pink and blue case. friends and family walked up to the crime tape to see that

phone shattered on the ground. it is the moment they realized it was her. cindy says she was here just after it happened, and says she talked to a witness. she says her daughter was walking along the tracks today, and she called to find out if her daughter was okay, and she was. but the desperate calls of britany silva were not answered. their grief shared by people taking in the scene. >> i feel bad. >> reporter: the family put this story together, of course by seeing that cell phone on the ground. it was confirmed when sheriffs deputies brought her purse to them. this is where she lived right behind us. there are conflicting reports. the police department says they have witnesses who saw her on her cell phone with ear buds in her ear, as she crossed those tracks. other witnesses say she had her

phone up to her ear, that's a detail that will likely be sorted out as this investigation goes on. last year, in california, 76 people were killed while walking on train tracks. that's more than in any other state. a new public service announcement hopes to remind people of the danger. we first showed you this image last month, a young man wearing ear buds walks oblivious along the tracks. the psa is part of a national campaign. a surprise for students and workers tonight as the locks were changed at a college campus in the south bay. tonight, we've learned that school, bryman college in san jose was evicted. reports from the campus on winchester boulevard, where students were left stunned. >> reporter: locked out. >> let's go this way to 108.

>> reporter: we found pete rekeying the campus after the landlord slapped the school with an eviction order. >> we change the locks so they can't come back in. >> how do you not pay your rent for a building? words can't even describe it. that's how mad i am. >> reporter: she was in class this afternoon when her instructor left the room, then returned and told everyone they had to get out. >> you had one hour to collect your things and get out of the school. >> yes. >> how does that make you feel? >> nervous, mad. >> reporter: this is part of a four campus chain of vocational schools here in california. i was told all of the other locations including hayward, and san francisco remain open. what happened here in san jose? >> we're just trying to find out why the bryman college was

suddenly closed. >> reporter: we went to the company which operates bryman looking for information, but didn't have any luck. >> do i transfer my credits to a different school. do i wait to find out if they're going to pay the rent and i can come back here? i have no idea what i'm going to do. >> reporter: she also walked away with plenty of questions and no answers. >> heather tells us, caldera was hoping to become a medical assistant, and has paid $16,000 in tuition. she and other students plan to return tomorrow at 10:00 a.m., when is when classes would normally begin. claims she physically confronted a 12-year-old boy who was allegedly bullying her daughter. >> he absolutely, and adamantly denies doing anything wrong. if the evidence shows otherwise, i'm going to fight this case vigorously. >> she's accused of putting her hands around the neck of a boy

at oliveette elementary school. some parents are defending the mother. others are not. >> it's really upsetting. i'm not exactly sure what to make of it. i just found out. so i mean, it's not acceptable. >> garcia told ktvu by phone, she never touched the boy, but sheriff's officials say they took pictures showing red marks on the boy's neck. investigators say this may be a case of mistaken identity, that the boy who was attacked had nothing to do with a bullying incident. new information about a man who fell to his death from a rock in the berkely hills. tonight, friends tell us, they're mystified why he was even there. >> reporter: frank, we learned today that he was 22, and from concord, and that he liked to come here with his friends to enjoy these amazing views.

but they say on those occasions, he never showed an interest in that rock. in fact, never left the parking lot. this evening, a young man balances on the same high perch where another fell to his death just 24 hours ago. the outcropping forms a steep cliff. you can see how the firefighter is dwarfed at the bottom of it. close to where lorenzo trujillo fell to his death. friends say he was caring, responsible, and cautious. when they heard his car was found her and he had hiked alone to the rock and fallen from it, it didn't fit from when they had come here with him. >> it's rare when he will get out of the car and walk around. >> so going over to the edge to walk down. >> he wouldn't do that. he would just say, i will wait for you in the car. >> didn't like heights?

>> reporter: this space is university property. the fire rode invites hiking, but off the trail, it can be tricky to navigate. and no signs warn of a hazard. >> you're taking a risk at that point. >> reporter: especially with the rock. once hidden behind trees, but now a visible attraction. these friends have climbed it many times. >> you can clearly tell, wait a minute, this is extremely high. >> it's a scary spot to be up there. it's high. over 100 feet. >> reporter: and why trujillo would venture out alone. >> his friends feel certain he would not intentionally harm himself. he has an older brother, also lives in concord. their parents are in mexico. uc police would like to hear

from anyone who saw him here yesterday, by himself, or with others. the man accused of killing sierra lamar is now facing the death penalty. he will seek the ultimate punishment against an antilin garcia torres. sierra's mother says she knows it will take a lot longer for the trial, since it is a death penalty case. >> it doesn't take away the angst, the waiting period. it's still difficult as a family to go through that. >> a legal analyst said the d.a. must be certain about the evidence, because sierra's body has never been found. a man in san jose has been arrested for killing his ex- wife. robbie williams murdered her last thursday. she was stabbed at least one

time. patricia harrison was found on canyon ridge drive after police received a 911 call. she is the 16th person killed in san jose so far this year. new information on a massive fire back in march. fire officials today said the welding work being done by the sub contractor tc steel out of petaluma is believed to have been what sparked the fire. the president of that company has been cited, and fined $100,000 for being out of compliance with the city's fire code. the five-alarm fire destroyed a 6 floor residential complex that was under construction on 4th street, causing $40 million in damage. new at 10:00, the 49ers are trying to ease fears about gridlock at the new levi stadium. last week, we told you about season ticket holders upset

about the lack of parking. tonight, they had a chance to share their concerns with 49ers management. >> at lake mill park, and this area is surrounded by homes. levi stadium, less than two miles away. i spoke to a man who is now planning to reschedule his life around on game days. 49ers management tells me they're doing the best they can not to inconvenience the people who live here. >> we're thinking of putting out no event parking signs. stuff like that. so it keeps the people out of our area. >> reporter: miguel alvarez was right across from levi stadium. while he recognizes it will bring money and jobs to santa clara, he's not looking forward to the estimated 68,000 fans on sundays. he is afraid rowdy fans will destroy the children's park. >> worried about drunk people

dropping glass bottles, as they walk by. >> reporter: addressing all of that at this lively community meeting tonight. saying all stadium parking lots will have specific crowds. >> traffic engineers who do this for a living understand traffic flow and traffic counts. so yeah, we put a lot of time and effort, and trust in those professionals. >> reporter: the 49ers are funding the salaries of an additional lieutenant and sergeant, specifically for the stadium. >> we've got agreements with california highway patrol and the sheriff's department to fund helicopters or traffic control. >> reporter: neighbors say only time will tell if that will be enough. >> it's yet to be seen. what can we say? if they say they've got it, do they? >> it might be fine, or it might kind of ruin the appeal of living here. >> people who live here aren't

the only ones concerns. i spoke to a vp, a 49er vp tonight. he says he hasn't heard about those complaints, yet he's willing to do all he can to help those who need it. ktvu, channel 2 news. the nba today started the process to take over control of the los angeles clippers from owner donald sterling. today the league notified sterling of the so-called charges against him, which include damaging the league, and its teams by making racist comments about african americans. sterling has already been banned for life, and fined. if the other team owners vote to uphold the charge, sterling will have to sell the team he has owned since 1981. we have a heads up for traffic delays in san jose. work crews are excavating a trench for the b.a.r.t. extension to silicone valley.

the trench will allow trains to run underground. traffic is going to be stopped every couple of minutes so that trucks can haul off the soil between 10:00 a.m. and 3:00 p.m. the work is done, the new blighter b. -- and this weekend, parts of interstate 260 will remain closed through the holiday weekend. it will affect a closure of 280 to the dog patch neighborhood. new at 10:00, ktvu's jana katsuyama live in san francisco with what's forcing that closure, and two more closures planned for this summer. >> reporter: the giants are expected to pull in big crowds for their home games in at&t park, and that could cause big shut downs. with a highway shut down of 280 that starts this thursday night. the signs are up, and caltrains is hoping people notice part of

280 will be closed this holiday weekend. crews must replace a hinge in the highway, which allows the highway to absorb movement during an earthquake. >> the hinges are located within the structure. so we have to demolish the roadway structure to get access to those hinges. >> reporter: the two mile stretch of southbound 280 will be shut down from the kings street onramp, to just before caesar chavez at the pennsylvania onramp. the hinge is located just north of caesar chavez. crews have been putting up large metal support structures. caltrain says they tried to alert neighbors there will be noise, dust, and detoured traffic. >> going to happen. they're inevitable in california, so you need the roads to be safe. >> reporter: one big challenge will be getting word out to the thousands of baseball fans expected downtown, as the giants host the twins, and then the cubs through the weekend. >> the giants are sending out

the event for rocana. congressman khanna is drawing a lot of competition. >> validating, and endorsing us, it was great to see rony lott out here. >> it could be khana vs. honda. oregon is now the latest state where same sex couples can get married after a federal judge struck down the ban. >> it is now with great pleasure, that i pronounce you spouses for life. >> one of the couples who challenged the ban in court was among the first to exchange their vows. they had been together for nearly 32 years. the judge ruled the ban was unconstitutional, and discriminatory. oregon's attorney general says she will not appeal the ruling. same-sex marriages are now legal in 17 states, and the district of columbia. no federal judge has upheld a ban since the u.s. supreme

court's decision last year, that invalidated the defense of marriage act. and that proved to be a major catalyst. could rivals apple and samsung be ready to make peace? that is the word from the korea times. the two companies have been battling over smartphone patent technology. samsung and apple have begun talks to settle their differences out of court. wall street made modest gains. internet and biotech stocks led the advances. and gopro, the maker of action cameras today issued its first public filing ahead of its public offering. it made just under $1 billion last year, as sales were up 87%. in the filing, it suggests it hopes to raise $100 million in its ipo, and it will list on

the nasdaq. a new proposal may restrict cars at one of san francisco's most famous attractions. lombard street hosts thousands every year who want to drive down that street. but some neighbors say it can take 90 minutes for them just to reach their homes because of all of that congestion. the number of traffic accidents is also up. tomorrow, a trial program would close lombard on weekends. the closure would take place between june 21 and july 14, and on the 4th of july. only residents would be allowed access. strong thunderstorms showing up in northern california at this hour. they've been going on all evening in the view county area along chico and paradise. we'll be watching it. up in this area, they've been

the lateddest computer model. we'll see you back here. fire officials in san diego county have put together an arson task force now to find the cause of every fire that was burning last week. they say they are investigating the larger devastating fires that made headlines along with several smaller ones that may be suspicious, and possibly connected. the task force includes local fire officials, along with cal fire, and federal investigators. they plan to compare notes in a meeting tomorrow. in all, more than 27,000 acres burned along with 47 homes, and an apartment complex. a fire and commercial planes. two investigates the danger that could quickly spread. >> he found out the car he was driving was stolen, after it was used in the movie pull be fiction. >> he says he requested a

new video tonight from oakland where police are investigating the city's 31st homicide of the year.

it happened on the 2600 block of international boulevard near the city's fruitvale district. a man was sitting in his car, when a man pulled up next to him and fired six or seven shots. san francisco police are investigating a deadly shooting that may have been sparked by a fender bender. it happened last november at a san francisco nightclub. investigators say 24-year-old michael green of san mateo was arrested last friday in florida. the victim's family told ktvu today, they want justice. >> he took a good person. why would you kill me baby? >> green was awaiting an extradition hearing before he can be sent back to san francisco where he will face charges of murder, and attempted murder. bubby paris has been sentenced to two years

probation for failure to pay his taxes. he bleeded guilty for a misdemeanor charge for failure to file a tax return for the 2006 tax year. he's also agreed to pay the irs more than $126,000 in fines. paris played for the 49ers from 1983 through 1990. he also appeared on ktvu's point after sports show. the u.s. filed unprecedented cyber espionage charges today against five chinese. the indictment named the five chinese officers and identified the building in shanghai, where the u.s. says they worked. the charges are likely to increase tensions between the u.s. and china. beijing is calling the allegations absurd. pleading guilty to criminal

conspiracy. the swiss bank was accused of helping clients hide assets in illegal and undeclared bank accounts. attorney general eric holder says today's plea shows no financial institution is above the law. 2 investigates tonight fires at 30,000 feet and the potentially serious risk of transporting lithium-ion batteries. on planes. >> 2 investigates has obtained video of government tests shows just how quickly palettes can ignite on an aircraft. tonight, that video, and new concern that a fix didn't go far enough. >> reporter: the tests make the batteries fail by doing what has made them fail in real operations. overcharging them, overheating

them, draining them too quickly, and damaging them. it gets even more dangerous when you have a cluster of lithiums that fail like a row of dominoes. those were a test of smaller battery. but what about the big ones used to power up passenger planes. investigators blamed lithiums in part for the destruction of three cargo planes since 2006, two of which crashed. the current missing malaysian airliner was carrying two and a half tons of lithium in its cargo hold. many foreign air carriers have no restrictions. the faa, which freely gave us this video, launched a series of full scale tests on a retired cargo jet. again and again, the test illustrates the potential for a fire to rapidly gain size and

strength. in one case, toxic smoke thickens throughout the plane, and the cockpit, obscuring the instrument panel and windows. in another, pressure released from the burning batteries did internal damage to the aircraft structure. in some cases, the tests were terminated because the fuselage got too hot. in excess of 1700 degrees. engineering professor elton karen's teaches the@u -- at the uc berkely. >> we're still working on how to get the lithium-ions safer. >> reporter: no space between them for cooling. the faa approved a resign, separating the batteries, and closing all of them in a stainless steel box, venting so they could cool with air. he isn't sure that is the best solution. >> i think a much better design would be to have a liquid

san francisco's sacred heart prep now admits being wrong for pulling a teen's photo. the principal is apologizing to both her and her family, and the high school's website, also posted a formal apology. >> in dealing with this young woman and her family and her situation, this is a deep part of who she is. she wasn't trying to make a public statement, she wasn't trying to do anything other than be true to herself. >> principal gary cannon says jessica's picture will now be inserted into roughly 1300 yearbooks. he also says seniors will get their copies as scheduled. a former cub scout leader pled not guilty today to charges of child sex abuse. ktvu brought you this story back in march. he is accused of sexually abusing a child over three or four years, starting before that child turned 12.

the alleged victim was a family friend, and not a scout. lee is a married stepfather of two children. disneyland is raising ticket prices, up to $600 for a family of four. it now costs $96 for single day admission to disneyland, or california adventure. that's a $4 increase. the cost of single day tickets has more than doubled since 2003. park hopper tickets also went up to $150 each, from $137. that means for a family of four, they would have to spend $600 for one day at both parks. chipotle is asking people who support open carry to please leave their guns home. it comes after assault rifles were brought to a chipotle in texas over the weekend. starbucks issued a similar request last year after a

demonstration at some of its coffeehouses. oakland's police chief sealed a deal today that may get young people to consider working for the department. the chief signed an affiliation agreement. the new program will link the administration of justice program at merit college with the police department. the officers will then be able to interact with students and offer support for a possible police career. mayor jean quan says it's hoping to attract more city residents. >> the last class had 16% oakland residents and i would like to get up to 50% of the classing about oakland residents. >> the city will be hiring another 60 officers, and she says signing up for an internship gives teenagers a good idea of what the job is like. new at 10:00, small business owners had a chance to

thieves are becoming more sophisticated at stealing cars thanks to new technology. >> a man actually drove a car for years, before knowing it was stolen from a hollywood director. >> bill jimenez of san leandro loved his '64 chevy malibu. he drove it to car shows around the state, then 12 years after he got it from a private seller, he got a call from police, saying they needed to inspect his car. investigators took the car apart and found the vin number didn't match the one on the frame or the title. >> he asked me a question, do you know who quentin tarantino is? nope. >> reporter: it identified the car as the one stolen from

quentin tarantino in 1995. it was this car, used in the film "pulp fiction." got the car registered and titled at the dmv with a fake number, and sold it. for more than a decade, jimenez never knew he was driving around a stolen car. >> how could this happen to me? >> he's out all the money and time he put into that car, and he's just one good example of this happens to people all the time. >> reporter: he recovers vin switched stolen vehicles like this one on a monthly basis. >> this is a 2012 audi a6. >> reporter: he says the buyer of this car bought it from a private seller for $24,000. the buyer had to give it back. he showed us where the vin number was switched out. >> they had to take the windshield out, and replace the old vin out, and replace it with the new vin.

>> with the color printers and 3d printers, it's becoming easier for crooks to produce vin plates. >> reporter: he says it's a good idea for a dealership to inspect the car and the vin number before you buy it. new video of an unusual arrest at yesterday's beta race in san francisco. it involved a partially naked man accused much harassing the bison. video posted on youtube shows the man wearing what appears to be a purple poncho, and walking up to the bison. in all, 34 people were cited during the beta breakers. a recent heat wave may be the reason thousands of fish have turned up dead. you can see the water in maria del rey. scientists are working to determine the exact cause for

the fish die off. they believe it to be a lack of oxygen in the water. people who live in the bay say the stench from the dead fish is overpowering. the agricultural committee could leave thousands of farmers without work. it estimates 6% of farmland in the central valley could go unplanted due to cuts in water deliveries. some fear recent efforts to kill weeds may actually be killing trees at a park in san ramon. a vegetation expert showed us trees that appear to be dying. he says the unhealthy trees are only near areas where the city of san ramon has been spraying with herbicide. >> as a professional i wouldn't put anything around these

trees. they need water, and that's it. it was a cool weekend around here. today was no different. temperatures today were mostly in the 60s, and low 70s. chilly, breezy. that was today. tomorrow, a little bit warmer, but still breezy. i think temperatures will come up a couple of degrees. santa rosa, just 71 today. downtown san francisco, just 62. can you remember a week ago? we had temperatures up in the 90-degree readings. so down almost 30 degrees in some places. check out this system to the north. this is what i'm tracking. i've got reports up in this area of rainfall accumulations up to a half inch of rain, which is great. great news. it's what they need. there is lightning strikes, but it's a wet lightning, which is better than a dry lightning. it continues up here near chico. this activity wants to work its way south as we go through tonight. but the model, as you will see isn't that bullish on bringing

any our way. the winds are blowing. starting to die down a little bit. the san francisco airport is down to 16 miles an hour. strong west winds will be breezy again tomorrow. this low pressure system starts to work its way south. as it does, we've got a chance for moisture to continue to stream into the area, and enhance a chance for a thunder shower or such tonight and again tomorrow afternoon. the model is going to bear this out. the forecast then, here we are at 8:00 a.m. a little sun out here by livermore, this is in the morning. it breaks out, nothing going on here. it's convective. in santa rosa, north up here around hillsberg, around 2:00, the outlook is pretty juicy. these are thunderstorms. up in hillsberg, you may see something. but nothing in san jose. if we do see it, that's how it will come. through the afternoon, a widely scattered chance of a shower. the chance of you seeing a
