>> welcome to the beat, everyone. we are beginning with a big show. we just have former supreme court justice stephen breyer joining us tonight. he recently retired, you may recall, and crated the vacancy for his former clerk. he is here tonight. and the coauthor of the art of the deal, tony swarts, returns with insight on donald trump's life as a defendant and a warning for any possible second term our top story is the latest in the legal problems that are swirling around trump considering right now he begins this week facing new testimony in the criminal trials a ruling on those gag order violations alleged by the d.a. fallout from new indictments of 18 allies for election crimes in the states. outrage over his own supreme court lawyer's claims about this license to kill and the

oral arguments which we got at the end of last week. the problems are breaking through in many different ways. in fact here is one way to put it. the collision of so many cases within a five day span underscores the challenge that candidate trump will face. that is how the ap noted, noting the message he has been repeatedly overshadowed. it is a reminder that because defendant trump has insisted on running for office, some of many people do not do. he is doing that and also playing against his own campaign , stuck for weeks in court and having all of this affected no matter what the outcome is of the new york case. as of all the stuff together, this is how it is piling up. >> reporter: tuesday is going to kick off the third week of this criminal hush money trial per >> the first ever trial of a criminal president >> reporter: the supreme court heard arguments in trump's claim brought immunity. >> reporter: it could reshape the future of presidential power. >> reporter: arizona is the

latest date to charge trump alleys for their part in eighth elector scheme. >> reporter: the president was named as unindicted co- conspirator. >> reporter: i gag order hearing on thursday to see if the former present has been violating -- >> it is so staggering that they could become -- >> not normal, extreme, numbing. these are clearly legally unusual times. and strange times. it is all accelerating. for people horse was to be impartial, where that is judges overseeing an case to independent reporters doing their best, just describing these abnormal and troubling realities can sell my criticism. if you say, they are talking about a license to kill innocent people, almost sounds like you are going at them when you're just accurately describe what they claim they can do in court, six months out of the election. the new york trout resumes tomorrow. i will be in the courtroom tomorrow.

we have been riding on our own team of reporters. i will be in that room and i will show you what icm learned that if you tune in. prosecutors will be calling more witnesses this week. both sides gearing up for michael cohen. prosecutors view him as the eyewitness to a campaign crime. defense lawyers, they think cohen could help. they view him and his past as a key to showing jurors some kind of reasonable doubt about the case. if you cannot trust cohen, they argue, how can you have comments beyond a reasonable doubt of the crime? new york is the only place where criminal trial of trump is on track to finish by the election. for all the punditry and discussions you may have heard about which case was stronger or should go first. going first implies there is a second but as of now, that looks unlikely. d.a. bragg is the one prosecutor who is putting trump on trial. that is a fact. he is only one on track to finish the trial by the

election for the atlanta d.a. move more slowly and less effectively. jack smith is hitting roadblocks beyond the control. first hobbled by the doj's late start. and then running into this maga friendly roadblock at the supreme court last week . that controversial hearing, which showed chief justice roberts presiding over the most obviously partisan court in the modern era. that should be an embarrassment to him given everything he said about independence or two justices who care about that. that might be a minority members of this court. i say that as an observation about the way the hearing went, not a criticism out of the air. here is a nonpartisan report from the new york times which notes conservatives on the court went in this unexpected direction last week without precedent, rushing to try to limit whether defendant trump can be put on trial at all. and putting a thumb on the scale in the timeline to probably delay it past the election.

here is the different trials we have been covering and may turn green. we have reported on those arguments. that night at the table our whole team talk.. there is no president for any president in any party having white immunity just because they once had the job of president. there is a lot of history on the other side from nixon and other areas and what you've heard from grade school on but no one is above the law. nobody means nobody or does it? since thursday more legal experts hitting the obvious partisanship at play. a court that claims to follow precedent and text is now -- we heard in the argument -- leaning towards ignoring text entirely. it does not say anywhere in the text of the constitution or the bill of rights or any of that, it does not say anything about having permanent immunity after you leave office. of course, trump appointees cannot cite any text in the constitution and that longhand that is supposed to guide us to

bail trump out. they would need something a lot more recent or nonbinding. i guess they could cite the text of the monopoly game i see get out of jail free card. those words were apply here. as you know, monopoly is just a game. as the supreme court slows the trial, the other thing as we start the week we're seeing is how the independent legal process around the country in states that are red, purple and blue continue to find evidence of 2020 election crimes. these are the stories that would be a huge deal if they broke in 2017 or 2018 or even right after the insurrection '21. 2024, as our colleague said, people are numb to this thing. it is actually a big deal. it is significant whether you are tired or not. that does not speak to significance. it speaks to your emotional news diet. i do understand it is a lot to keep track of. whether you are used to it or

not, numb to it or not, it is a big deal that arizona and michigan are barreling forward with these cases just in the last week. evidence there supporting defendant trump in new york and also being branded and unindicted co-conspirator in those cases. while his aides faced fresh charges. even more heat in one of the cases today that we just learned about, a former trump aide caught up with michigan prosecutors new searches for evidence from google and x involving kenneth chesebro. cnn has that report but we have not confirmed it. as we track all of the plot, most involved trump and his aides and others willing to help them. it takes a lot of people to pursue this many separate plots. i will not read them all out. there is roughly seven. in arizona, alone, it is 18 total people, republican operatives and aides charged

with the crimes from 2020. that includes people who responded to truck campaign's call to pose as electors in states that biden had won. people get in trouble just for lying on their own taxes, just about their own finances or lying to a bank to take out a loan or start a business. lying to the federal government and the state government to steal an entire national election is a very big deal, legally and substantively. we are talking about right now. take the arizona residents who claim they were the real electors after trump had already lost. they are indicted for the fraud that you can see on your screen and charged with crimes of forgery and fraud that they filmed themselves. here they are signing fraudulent certificates in a place were trump lost saying they were the rightful electors. with all those arrows had worked better and more effective crime spree, these are the people that would have been cited by mike pence or a different vice president on the senate floor saying, these are the real electors.

it matters a lot that in their own state, they are criminal defendants and not some jump ball were up is down and the myers claim they represent the people. republican party has not gotten the message. they are promoting some of these very indicted individuals to republican national committees. the defendants are responsible for their own actions. those who have spoken out in these pots i tell you about -- sometimes at the local level -- mercury responding to the prodding and the talking points of what was left of the truck campaign. here is one discussing about two years back. remember what authority did you find yourself as an elector? >> in unprecedented times and action. there is no case law. there is no president that exist as to whether or not an election that is currently being litigated in the courts has to standing. which is why we felt it appropriate to provide congress and the vice president with dueling opinions.

>> if you say it and you pause and you use words like precedent , are you a criminal? look, what you heard was faults. like everyone else indicted, everyone is presumed innocent. and they will go through the court process. there actually is a lot of precedent. you do not need to actually be a lawyer to cut through this. you were never bush v. goor. your member what it looks like when there is a closely contested election there is really tight races with him 500 vote and you have a recount but that was not the case. president-elect biden was the winner. and won by three states. the supreme court even with appointees that are on their did not ever see any evidence that led them to even take a case, let alone hold or go -- oral arguments with the maga theory site but when you use words to talk about the fraud ,

is no different than if they said, i don't like what the bank did. i will take the money because i think it is rightfully mine. that is not your money. this was not their election to overthrow. contrast tonight, i think it's pretty glaring. the highest judges in the land are minimizing january 6th they are helping defend trump all the evidence in the court around the nation, i just showed you, are actually working. they address the election crimes. four different states in diving the election fraud. four states in three years ago. trump's aides and lawyers face an onslaught of legal consequences that we are tracking. here is some of them and some of the stamps that they faced to just give you a brief overview. we are looking at disbarment and penalties and fines, and charges. those who are charged get a trial and

presumed innocent but that is part of the accountability. we are also looking at some conventions but in the lower left, we look at some prison in the case of mr. navarro and mr. bannon, awaiting a prison sentence for his conviction but he is currently out on appeal. as for the lore i mentioned, chesebro, he is named as a co- conspirator in the new arizona case you're keeping track, he is one of the industry was convicted in georgia, admitting fault just like his fellow disgraced trump lawyer, jenna ellis. >> how do you plead to count 15, conspiracy to commit false documents into number 23 188947? >> guilty. >> if i knew then what i know now, i would have declined to represent donald trump in these postelection challenges. i look back on the six brands with deep remorse. >> okay. deep remorse. none of this is easy for anyone going. even if they made mistakes. the process that we have,

especially for noncapital offenses with the vast majority of trials is to try to give people a chance even when they are being held accountable. that is why judges take testimony even from people before sentencing. remorse is a start but accountable he is important. it has come to many people in these cases. just not the defendant at the very top. all the talk about politics or ideology these days, what we learned at the supreme court last week is the majority was fixated on hierarchy and protecting its, apparently favorite person, who was at the very top. the ex-president running for president again. the court did not raise the same questions or concerns about the convicted aides that you just saw. or how future aids or lawyers, or generals, or attorney general's would do their difficult jobs with the possible threat of later accountable if they commit latent crimes. for some reason that concern was just for donald trump.

i tell you as we start this week, we are living through a time of some accountability for nbc news the eight enablers at the bottom and in the middle. there is a bunch of proud boy stuck in prison for years. we are also living through something that got even more clarified and exposed on thursday. a kind of elite maga protection racket within our own government at the very top. the supreme court have life tenure the defendant they so clearly favor, the majority of them, is one that appointed them and they work for. apparently, they do not care how it affects their own reputations. this is so important to them. it is almost strange to see the contrast. legally, it is antithetical to the constitution that the high court claims to interpret. it is a lot from these multiple perspectives but tonight we begin with something that we think could be informative and worthwhile. we want to hear from one of the lawyers for one of the trump

we want that normalcy. we want a predictable process but regardless of who wins up and loses at the end of the day, we want to get back to the business of america. you might top arizona election officials speaking about the new charges but we have neil who joins us tonight in the segment. as we look at all of this but we begin as prize with manny aurora. chesebro's attorney. that is the convicted trump aid i told you about the courtesy of cnn, that the attorney general did a search warrant in michigan breaking tonight. it occurred last month giving prosecutors access to his emails, messages online. the warrants made clear that she is still the attorney general and gathering information. starting with that news, is that something you are aware of and does your client have any other legal jeopardy in that state? >> there is no legal jeopardy. we have incorporating the whole time. we have already provided the information in order to be a good prosecutor you want to get the search warrants. double

check us and make sure we have given them everything. i expect all the states to do something similar. i don't think it amounts to a whole lot. it is what needs to be done. >> your view is anything related to x, google and those messages, you did provide that. they are cross-referencing it but you have turned it over? >> absolutely. if the defense lawyers would say, there is some stuff missing , you want to make sure that you have done a full search through those accounts and there is no issues as far as a discovery violation. simply saying this other gentleman provided it, it may not be the entire story. we believe we have provided everything. as other guests would tell you, we can challenge the surges since it is a private search for when we get noticed, we chose not to do that. we have provided everything and hopefully this will confirm all that. >> what you think about the point i raised -- i'm sure you watch the supreme court arguments with interest.

a lot of hypotheticals about what could affect the president or post-presidency life. you represent someone who went through best and there is others , as i noted, who faced accountability. you think there is a bit of a double standard in the hierarchy? >> the questioning was a little unusual to me. for hundreds of years, ever since the inception of our country we have not have this problem. suddenly, what about teacher presidents? what are they going to do it is not that hard not to break the law. i don't see that as a big issue. i wish they could simply figure out what it is that they are trying to find out where it is personal or private but he did it in whatever capacity. if it is legal, it is legal. to make it personal versus in his official capacity in order to . future issues, i do not see this being that big of a deal, frankly. i think we are making a mountain out of a mole hill. >> interesting. what is mostly the core conservatives that we heard from. i want to read from other

reporting with what is going on states. this is in the new york times. faced with criminal charges in the state inquiry some of trump's allies have bachrach -- backtrack. faced with criminal charges in the state election inquiries, some of mr. trump's, the state trooper who was a last-minute sub as a fake elector expressed regret to investigator saying he had been walked into a situation i should not have been involved in. is that reporting basically right? do you think mr. chesebro having gone through this year has learned or involved or does not want to own what at the time was sold as an alternative way to overthrow the whole election with people in states that biden won claiming they were trump electors? >> let us look at it in context. mr. chesebro worked for gore back in 2000 and thought there were other theories that could've been put forward prior to the election challenge coming to a close. he put together his memos and

we may agree or disagree with what we believe with the validity of those. i thought there was support, legally, for what he said. it is historic and there is no clear about one way or the other. >> he was convicted and he says it was find that it was potential but he says biden was elected. he stands by that? >> absolutely. he was convicted on count 15. what i will have everyone remember is me pled guilty to the count but we did not put the saving language in there like we did in pennsylvania, new mexico and some of the other states that do not have investigations we said the alternate electors are only valid if there is a valid lawsuit and that language is put on the states. each state have his own decision to make where you want to use that language. some of the emails were people in the trump campaign said -- that. his position is always these are my points and it is always based on the fact that there is a lawsuit. we had nothing to do with the underlying state suits.

the memo spoke for themselves. he put things in there saying you can be treasonous to go past this level or that level. haven't georgia really spoken to mr. chesebro and talk to him like six other states had come i don't know if he got charge but once they were fully understood what our position -- >> i understand the distinction you are drying and why that could matter. meanwhile the supreme court saying, maybe trump won't have to face any judgment, unlike your client. manny arora, i appreciate you coming on . on a lighter note, i appreciate you pulling over. they don't want you texting and driving and they do not want you doing live tv and driving. >> that is why i have senior associates to help me drive around. i appreciate you having me on. >> as promised we turn now to present obama's former asking acting associate general but for shabazz in any or all of the above? >> i want to say it is fabulous you're about to have the

justice on your show but i have the privilege of working for him and he is a model person. i am so glad your viewers will get to see what i got to see every day. with respect to the lawyer for mr. chesebro -- >> i will tell you, i can hear you we might put other footage up because we have your audio but we have your visual frozen. control room, we might throw up other sketches or staff. we can hear you. go ahead, i wanted to tell viewers that is what is happening. >> thank you. let me say three things about what we heard from chesebro's lawyer. i thought it was interesting that he dissed the supreme court argument on absolute immunity. and said we do not have a problem for 200 years. why is he thinking there is a problem? second, i thought has explanation for mr. chesebro saying he has been consistent since what he did with al gore

in 2000 is some sort of defense. that is bogus. i was a lawyer on the court team. i saw those memos. there is zero support for the idea but you could have fake elector scheme or anything like that. that is just slightly wrong. third, i thought it was really interesting that the lawyer for mr. chesebro said that mr. chesebro always believed that his elector scheme was contingent on upending valid lawsuit. that is just wrong. littler has a credibility problem or at least it appears that way. maybe there is something i am missing but the client sure seems tab. that client has a december 8th, 2020, email that says it is not contingent -- is fake elector strategy is not contingent on litigation advice. he says we should run the strategy, quote, even if there is no litigation pending on january 6th. we met you make an important fact check. that speaks as well why they wanted to run all the way to the

senate with or without other cases. i want to play someone that we all know well, bill barnes who spoke to cnn. and spoke about that contentious supreme court hearing thursday. take a listen. >> the question is, is something you are authorized to do and have the duty to do and execute the law and so forth? the answer is not. the president does not have the to wage against the constitution of the united states. he does not have the authority to tell enemies or rivals. those are odyssey acts that are not authorized hard for him to do his job. >> your thoughts on what it means to have attorney general bar, because he zigzags a lot. he does support trump's re- election. as a legal matter, those are observed and extreme claims. as you heard, you are good so

many places, more cases than most living lawyers. the question suggested some of the justices were hearing out those arguments. >> when you have lost billon your legal claims, you have lost everyone. it is notable that msnbc -- six is taking that position and saying he would vote for donald trump to be president. anyone who runs ramshackle over constitutional limits does not deserve to be anywhere near the oval office. i was in the courtroom for the supreme court argument last week. i do think -- i wish every american could see it. there is a lot of nuance that i think was lost because you cannot see the facial expressions and the like. sure, the justices were entertaining big hypotheticals whether it is eight coup or something like that. at the end of the day, the lawyer for jack smith did make a lot of headway. i'm not sure the reporting really captured all of that after the argument.

can we just acknowledge how refreshing it is to see a president of the united states at an event does not begin with a veil of saying, all rise. >> [ laughter ] >> that is just how it played down in washington over the weekend we are joined by the ghost writer coauthor for the art of the deal. a longtime journalist. thanks for being here. >> thank you for having me. >> you knew trump and long before he was a criminal defendant. how do you see this affecting him as we go into weeks of this trial? >> i am a little surprise, ari, that he has not blown yet. i think the pressure inside -- there is no greater punishment. i was thinking about this. there is almost no greater punishment he can give donald trump and not being able to talk. almost equally is not being able to dominate i think the

idea of him sitting there, you know, every day, squeeze between his lawyers and hunched over, yawning, sometimes sleeping, has already changed the narrative of this presidential race. he can never, ever called joe biden sleepy joe again. >> we have those headlines. the narrative was there is an old guy running. then you watch biden in the correspondent center and you listen to trump if you go on google and caught up trump misspeaking, you will see these extraordinary moments where he clearly has completely lost the narrative for himself. i think this is an incredibly painful period for trump. >> when you look at how he responds. he will come out and give speeches. we just saw biden do the jokes at the correspondence weekend

and he refers to his own age and this and that he is trying to find different ways to connect with the public. he did howard stern. just a brief moment there. when you look at the discussion about how we experience things together, it is really like the super bowl and presidential debate and that is it. everything else is you have version, they have their version. him and tells you might uncle told me about january 6th. that is different than whether you watch the video. i was going show the clip but go ahead. it is insane. this is reality. you will show the clip and it will be the reality. we know what happened. >> biden is saying that he is still down to do a debate. take a look. >> can i take a fantasy i had? i don't know if you will debate your opponent. >> i am, somewhere. i am happy to debate him. >> low-key, happy to debate him. do you think the way they are right now that that would be a good idea? if so, how do you deal with trump coming off the trial, this angry and biden presenting

this week many are awaiting a ruling about defendant trump's alleged violations of the gag order. violations include smearing the presiding judge's family, which is john rebukes from legal experts but right now we turn to something where, of you from an actual supreme court justice, stephen breyer, who serves when clinton appointed him until 2022 when biden

tapped his replacement with a new interview spoke about respect for judges and also declined to specifically address defendant trump's statements. you have a former president who is also running for office. who is going through our justice system. as we know he is legally presumed innocent and the process plays out. unlike almost all defendants, he has repeatedly attacked judges. almost during the system to see what it might do. for example, attacking the judge overseeing the new york trial as totally compromised. he should be removed, attacking his daughter. he published byes about his daughter about our faults. i will not repeat them here. by one count from reuters, the number of threats and hostile communications made towards judges and the court staff has more than tripled since 2015. you are a judge. and as a justice retired, you

still go on and can judge federal appeals, which we were discussing. is that kind of attack protected free speech or is it wrong? what do we do about increasing documented threats against judges in our country? >> i cannot answer the political parts. >> you are careful to devoid -- of what anything with defendant trump. we met you can say with regard to anyone. to physically threaten someone, to physically threaten a judge, to physically threaten a physical -- civil servant, to physically threaten someone who works in the government. to physically threaten someone who does not work in the government is wrong. >> wrong but that is justice breyer, speaking in general. careful not to get into the trump thing. on the court he offered some

rulings on speech and healthcare. as the court turned conservative, breyer was a voice in major dissent with axis and certainly abortion- rights. it was in his final term that core conservatives ended roe v. wade and abortion-rights as a federal matter. that continues to reverberate today, as you surely know. the court's secret draft opinion was also leaked to the public in that case, highly unusual. intrigue swirled about whether a justice was involved. there were even theories about whether a conservative justice might be more involved to try to lock in what they had on their hands, a draft opinion that was going their way. most justices avoided commenting on that at all but i did ask breyer about it. hear his answer airing for the first time now. where were you when i heard that a draft opinion leaked of it? >> i did not know where i was. i cannot remember where i was. >> what did you think? >> that is what i can remember. i thought this is unfortunate. very, unusual for something to leak. >> is it fair to say that at

this moment, you, a member of the court, do not know who leaked it? >> that is correct. >> does it concern you it was leaked? do you think there was a goal or motive from within the court? should we expect more leaks or not of draft opinions? i would be concerned. it is not the first time. it does not happen often. it has not been desirable when it does. the court is pretty good, not perfect, obviously, but pretty good at not releasing things privately and not leaking things. obviously, not perfect. >> there is a concern or view that it came from within the court. that is to distort the process for talking about mac per do you have any view of that? >> i can't be because i do not know. >> it might have but i don't know. it sounds honest and pretty careful. when the final decision did come out, breyer joined the dissent.

i asked about the warnings that he and his colleagues wrote that proved true in dissenting to the decision overturning roe v. wade. the majority said that this is simple. they will overturn it and go back to the states. it will be as you say, they say, a simple process from there. that is not what has happened. the dissent warned about that. you said no one should be, quote, confident the majority is done with his work the right that was recognized does not stand alone. you also wrote, quote, winning lacking financial resources will suffer from the decision. a comet who spoke with npr set in the first year since the roe decision was struck, 100,000 lower income women would be restricted from getting an abortion. whereas people who are wealthier might be able to abate the restriction through travel and other means. is it fair to have something that seems to discriminate among other reasons on wealth? you will pardon my confirmation

or potential flattery, but you and the dissenters were pressing it. you were right. what do we take from that now? that this is not resolved. we have seen in our audience is well aware of the fights going on. in some places criminalizing abortion. and in some places criminalizing and presenting data preventing ivf, fertility and other measures. how do you feel being right? which we take from this? >> i do not feel good from being right because i do not like the result. why i wrote this book was not just to explain the result in that case. but to say more than people think, more than people think, it is not a question of politics. it is not a question of the judges being politicians. i would put higher on the list, higher on the list of reasons that they got there. i cannot read another person's mind. cases that i think are pretty

unfortunate, of which there are several here, i think it is a method. it is a method that they are adopting. it is a way of thinking about law. it is an approach to the interpretation of law. and the best way for me to try to change that approach, since i am a lawyer, since i am a judge, since it is what i have learned, is to explain -- explain to people who are not familiar with the court orcutt lane to people who are on the court. don't you see where you are going? so far, it has not been great. maybe it will even be worse. it is time to stop. it is time to go back to the more traditional methods of looking at consequences and looking at purposes and looking at values. >> looking at values and taking it all in but that is justice breyer. we talked to people in our
